WebExtra Terms and Conditions

Domain Name Registration – refers to the purchasing of one domain name only. Once your domain name is registered, it cannot be changed. Choose carefully and make sure it relates to your business name and the services you provide eg. www.bobscars.com.au

Extra domain names can be purchased at $66 GST INC and pointed to your website.

Website and Email Hosting – refers to the purchasing of server space to store your website content and email accounts. The maximum amount of email accounts you are entitled to is listed in your web pack description. ‘Storage space’ refers to the amount of data (in MB or GB) your hosting account will accommodate. Should you reach your maximum capacity, you will be unable to upload any further content to your website. ‘Monthly outgoing traffic’ refers to the bandwidth allowance your website is granted. If you experience high volumes of traffic and exceed your monthly quota, your website will be inaccessible. You can upgrade your hosting account at any time by contacting us.

Extra email accounts can be purchased at $16.50 per year, per account. Extra storage space can be purchased at $33 per year, per 100MB. Extra monthly outgoing traffic can be purchased at $55 per year, per GB. Extra domain names can be purchased at $38.50 per year, with a maximum of 5 domain names per hosting account.

‘Hosting Pack 3’ does not include an SSL Certificate nor the use of an https:// protocol. ‘Hosting Pack 3’ does not include a static IP.

Turnaround Time – refers to the time taken to deliver your website project. This time does not take into account the delay in your response time to WebExtra’s requests for your feedback or website content provision.

Web Startup Kit – ‘Splash Page’ refers to the design and development of one webpage only, containing your business logo, contact details and contact form. No extra services are provided unless specifically purchased as a bolt-on.

Web Pack 1 – refers to the design and development of a 5 page website. Included within ‘Web Pack 1’ is one design concept and a contact form for your contact page. Web Pack 1 does not include any additional functionality. Additional functionality such as dynamic content management must be purchased as a bolt-on. For your convenience, legal disclaimer and terms & conditions pages (required by law) are not included within the 5 page limit.

Web Pack 2 – refers to the design and development of a 10 page website. Included within ‘Web Pack 2’ is one concept design, a contact form for your contact page and the implementation of 1 drop down menu. ‘Web Pack 2’ does not include any additional functionality. Additional functionality such as dynamic content management must be purchased as a bolt-on. For your convenience, legal disclaimer and terms & conditions pages (required by law) are not included within the 5 page limit.

Web Pack 3 – refers to the design and development of a dynamic eCommerce website. Included within ‘Web Pack 3’ is the following:

  • One concept design.
  • A contact form for your contact page.
  • Implementation of 2 drop down menus.
  • A product catalogue consisting of a maximum of 50 products.
  • Shopping Cart functionality for public product purchasing.
  • Secure password protected administration control panel containing:
    • Product management tools to add, edit and delete products.
    • Order management tools to track the status of customer orders.
    • A Content Management System to edit website page titles, sections and content.
    • Conversion statistics tools to track the amount of visitors and sales

‘Web Pack 3’ does not include any additional functionality. Additional functionality such as Search Engine Optimisation must be purchased as a bolt-on. For your convenience, legal disclaimer and terms & conditions pages (required by law) are not included with in the 5 page limit.

To upgrade to an eCommerce store with an unlimited product catalogue will require you to purchase our ‘eCommerce Unleashed’ bolt-on.

‘Web Pack 3’ and ‘Hosting Pack 3’ does not come with an SSL Certificate nor the use of an https:// protocol. ‘Web Pack 3’ does not include a secure payment gateway nor does it include a static IP. Instead, secure payments are handled by PayPal. Your PayPal account usage is governed by a Privacy Policy, Legal Agreements, PDS and fees outside that of your WebExtra agreement. Extra Web Pages – If the page allowance in your web pack is insufficient to your needs, extra pages can be bought at $165 per page.

One (1) Design Concept – refers to the creation of your webpage design, look and feel. Only one design concept is produced per website project. This design is limited to the website template chosen, or the creation of a custom design. Custom design work can be purchased in blocks of 3, 6 or 9 hours as part of our web bolt-ons.

Custom Website Design - refers to custom website design work that can be purchased in blocks of 3, 6 or 9 hours as part of our web bolt-ons. Custom website design is restricted to website look and feel and does not include logo, icon or any other secondary graphic design unless specified.

Email Marketer – refers to a secure password protected online application used to send email campaigns to your contacts. The email addresses in your contact lists must be obtained lawfully. Federal laws govern the use of email campaigns with malicious, offensive or fraudulent use considered as cybercrime. WebExtra do not condone the misuse of email marketer for malicious, offensive or fraudulent activities and will hold users liable for their actions.

Search Engine Optimisation – refers to the best practices employed by WebExtra to improve your website’s visibility to search engines. This increase in visibility typically results in improved search engine rankings. No guarantees are placed on search engine optimisation as search engines are a third party. ‘Traffic Management’ refers to the website performance statistics generated to demonstrate incoming visitors to your website. ‘Search Term Analysis’ refers to the process of establishing the efficiency of the targeted keywords in your SEO campaign. ‘Linking Campaign’ refers to the setup of one way links from website directories and search engines to your website. ‘Ranking Reports’ refers to a compilation demonstrating the current website rankings for your targeted search terms. 'Search Engine Marketing' refers to 'Pay-Per-Click' search engine advertising.

Image Gallery – refers to an animated slideshow of your company related imagery. You will be required to provide this imagery to WebExtra for inclusion into the slideshow. For advanced users, image gallery photo management is included within the Content Management System bolt-on.

Content Management System – refers to a secure password protected dynamic application used to edit your website content.

Flash Banner Animation–refers to a custom created in-line website animation. Flash animation is restricted to website headers and banners, displaying company related imagery, products and logos. The purchase of 1 Flash Banner Animation bolt-on entitles you to 1 storyboard of animation and can only include a maximum of 10 images.

Website Maintenance–refers to WebExtra's time updating your website content. If the Content Management System option is not taken, simple text and image updates can be completed at $99 per hour GST INC. These updates are limited to website text and image content only, and does not cover website artwork design elements or dynamic bolt-on functionality modifications.

All prices quoted are GST inclusive.

WebExtra reserves the right to update the information on products outlined within these terms and conditions without notice. If a service or item of functionality is not mentioned within a web pack description, it is not provided as part of that web pack. Any custom development deemed outside the scope of any web pack by WebExtra staff will be charged at $132 per hour GST INC. If you’re unsure about the scope of your web pack, please contact us.

Website Hosting

Services

WebExtra's web site hosting service will operate according to the specifications of the service chosen.

Occasionally, scheduled downtime and circumstances beyond our control may cause your web site or email to be unavailable. We will make all reasonable endeavors to keep 'downtime' to a minimum. You agree to not hold WebExtra liable for any losses, including financial, due to the failure of any such web site, email and/or other services provided by WebExtra. However, if WebExtra does not maintain an 'uptime' for over 99% in any given month for web site or email hosting services, you may apply for a refund for that month's service.

Privacy

Your web site and email content is your business. Only in the event that WebExtra is served with a legally valid takedown order will we exercise censorship of your web site, with the exception being if the account is cancelled by WebExtra. However, it is a condition that you ensure the content of your web site and your use of the service does not infringe any Australia law or those in any other location in which you are conducting business. While every domain's contact details are available through Internet Domain records, your personal billing details or web site hosting account activity logs will not be released without your permission, except in the case of legal compulsion such as a court order.

Liabilities

WebExtra's 'anti spam' policy forbids the use of WebExtra email facilities for the sending of unsolicited commercial email such as advertisements for products and/or services, unless the receiver has specifically given their permission to receive such emails. Such activities are also contravened by Australian Federal Law under the Spam Act 2003 and the Spam (Consequential Amendments) Bill 2003. WebExtra may withdraw your hosting service without notice if you violate this policy and/or law. All activities and information hosted or transmitted from this service, whether by web site hosting, email or by other means, should not violate copyright law, defraud or defame people and/or organisations, or violate any other law either existing or coming into effect law during the period of the service. This includes, but is not limited to, the use of services supplied to illegally enter another computer system or disrupt the exchange of data. Violation of the policy may result in withdrawal of your hosting service without notice.

You agree to not hold WebExtra liable for any losses, including financial, due to copyright, legal or other infringement resulting from your web site or use of the service. You further agree to indemnify WebExtra from any action by third parties resulting from your web site or any other use of your web site hosting service. You agree that WebExtra does not accept any legal responsibility or legal liability for the security of data hosted or transmitted from its servers. Further, you agree that WebExtra will not be held jointly or severally liable for claims of damage or loss arising from unauthorized viewing, copying, modification or any other use of such data, whether by your or by a third party. You agree that under no circumstance shall WebExtra be responsible for end-user traffic or telephony charges. You hereby indemnify WebExtra against all and any liability relating thereto, either from yourself or any third party due to misuse by yourself or any third party of the service supplied. Misuse of any supplied services may result in WebExtra canceling your service without notice.

Support

Support is available during normal business hours, 9am to 5pm +8 GMT, Monday through Friday, excluding Western Australian public holidays. This support is provided by sending emails to support@webextra.com.au. Failure of services may be reported at any time via email. All support given by WebExtra staff is deemed correct only by the information presented and is provided in good faith. However, you agree that WebExtra will not be liable for claims or damage or loss arising from any support provided.
